16 Ağustos 2015 tarihinden bu yana başta Diyarbakır, Şırnak ve Mardin olmak üzere Hakkâri, Muş, Elazığ ve Batman’ın da olduğu toplam 7 ildeki, en az 19 ilçede, resmi olarak tespit edilebilen en az 58 süresiz ve gün boyu sokağa çıkma yasağı ilânı gerçekleşmiştir. Bu yasaklardan etkilenen en az 1 milyon 377 bin kişinin en temel yaşam ve sağlık hakları ihlâl edilmiş olup Türkiye İnsan Hakları Vakfı (TİHV) Dokümantasyon Merkezi verilerine göre, son 5 ay içerisinde en az 209 sivil (39’u çocuk, 32’si kadın, 30’u 60 yaş üstü) ve ayrıca 1 karında ateşli silahla vurulma sonucu ölü doğum, sadece resmi sokağa çıkma yasağı ilânı olan zaman dilimleri içerisinde yaşamlarını yitirmiştir. Sınırlı bilgiye karşılık mevcut durum koşulların ne kadar dehşet verici olduğunu yeterince ortaya koymaktadır.
Avrupa İnsan Hakları Komiserinin açıklamalarına göre Ağustos ayından bu yana Türkiye’nin Güneydoğusunda ne zaman sonlanacağı belli olmayan şekilde uygulanan sıklıkla ve pek çok bölgede ilan edilen sokağa çıkma yasakları, demokratik bir toplumun gerekleri olan orantılılık ve zorunluluk prensiplerinin ihlali anlamına gelmektedir.
Bu süreçte, kamu hastaneleri özel harekat polisi tarafından neredeyse tümüyle işgal edilmiş, hastane bahçelri panzerler tarafından zapt edilmiş, özel harekat polisinin üs olarak kullanması için acil servisler boşaltılmıştır. Cizre Devlet Hastanesi acil servisi boşaltılarak özel harekat polisine tahsis edilmiştir. Bu hastanenin yoğun bakım ünitesi de acil servise çevrilmiştir. Özellikle yaralı güvenlik güçleri ve şüpheliler hastaneye getirildiğinde, muyene süresince hastane bahçesi ve çevresi güvenlik güçleri tarafından ablukaya alınmakta ve kuşatma mantığı hastanenin içine de sızmaktadır. Özel harekat polisi sağlık kurumlarına getirilen hasta ve yaralılara işkence ve kötü muamelede bulunmaktadır.
Hastaneye başvuru sayılarında ciddi düzeyde düşüş vardır ve hukuksuz uygulamalar nedeniyle doğumlar hastanede gerçekleştirilememektedir. Yaralıların ve kronik hastalığı olanların sağlık kurumlarına erişiminin önünde çok ciddi engeller bulunmaktadır. Hastane acil servisine günlük başvuru sayısı, polikliniklerde muayene sayısı, toplam hasta sayısı gibi kriterler bağlamında önceki aylarla karşılaştırıldığında dramatic bir düşüş söz konusudur. Evde bakım hizmetleri bitmiştir.
Silahlı Çatışmalar ve Diğer Şiddet Durumlarına İlişkin Dünya Tabipler Birliği’nin sağlık alanına dair kurallarına yetkililerce ve güvenlik güçleri yöneticilerince itibar edilmemektedir. Bu tazr hukuksuz pratikler, sağlık ortamının güvenliğini bozmakta ve aynı zamanda sağlık emekçilerini ve sağlık kurumlarını hedef haline dönüştürmektedir. Böyle bir ortam, çalışma isteğini ortadan kaldıran son derece güvensiz koşullar yaratmaktadır. Bu nedenle çok sayıda sağlık emekçisi izin alarak, istifa ederek ya da tayin isteyerek yaşadığı yerden uzaklaşma çabasındadır. Devam eden çatışmalar, kötü muamele ve baskı nedeniyle sağlık emekçilerinin ruh sağlığı bozulmuştur ve bu koşullarda çalışmak istememektedirler. Çatışma ortamı nedeniyle oluşan travma, anksiyete bozuklukları, depresyon ve akut stres tepkisi şeklinde açığa çıkmaktadır. Savaş ortamı uzun vadede tüm toplum açısından ama özellikle de çocuklar açısından mental travmaya sebep olabilir.
Cizre Devlet Hastanesi Acil Servisi’nde çalışan üyemiz Eyüp Ergen 29 Ağutos tarihinde nöbet çıkışında aracının içinde iken özel harekat polisleri tarafından vurularak katledilmiştir. Üyemiz polisin ambulans geçişine izin vermemesi nedeniyle yaralı halde bir saatten fazla bekletilmiş ve bunun sonucunda hayatını kaybetmiştir. Yine, Beytüşşebap’ta çalışan üyemiz Şehmuz Dursun 25 Eylül 2015 tarihinde, görevi başındayken içinde olduğu ambulansın polis noktasından açılan ateşle taranması sonucu hayatını kaybetmiştir. 30 Aralık 2015 tarihnde SES Cizre Temsilciliği yönetim kurulu üyemiz hemşire Aziz Yural, yaralı bir kadına yardım etmek isterken özel harekat polislerince katledilmiştir. Üyemiz olan ve olmayan çok sayıda sağlık emekçisi yaralanmış, hakaret ve tehditlere maruz kalmıştır.
23 Ocak 2016 gününden beri içinde çocukların da olduğu 20’den fazla kişi Cizre’de yoğun bombardıman altındaki bir apartmanın bodrum katında hayatta kalmaya çalışmaktadırlar. Olay öncesinde ve süresince, demokratik örgütler ve bireysel inisiyatifler aracılığıyla Avrupa İnsan Hakları Mahkemesi’nden yaralı beş kişinin hastaneye ulaştırılmasını garanti altına almak için tedbir kararı çıkartılmıştır. Hakkında AİHM’den tedbir kararı çıkan beş yaralıdan üçü (Cihan Karaman, Hüseyin Paksoy and Serhat Altun) hayatını kaybetmiştir, biri (Helin Öncü) ağır yaralı olarak hastaneye kaldırılmıştır ve bir yaralı (Orhan Tunç) hakkında maalesef bilgi alınamamaktadır.
Avrupa İnsan Hakları Mahkemesi kararlarına rağmen, içinde yaralıların da olduğu 20’den fazla kişinin sığındığı binaya yönelik saldırılar devam etmektedir ve yaralıları durumu an be an kötüleşmektedir. Türkiye’nin de taraf olduğu uluslararası sözleşmelere göre yaşam hakkı ve sağlık hakkı gibi temel insan hakları vazgeçilemezdir. Bu nedenle, Türkiye’ye heyet ziyareti gerçekleştirmeniz, bahsedilen bölgelerde incelemelerde bulunmanız ve Türk otoritelerinin bir an önce sokağa çıkma yasaklarını kaldırması yönünde uyarılmasını çerecek biçimde sağlık hakkının kullanılabilmesi için acil önlemlerin alınmasını sağlamanız konusunda harekete geçmeye çağırıyoruz.

As of 16 August 2015, there has been 58 officially confirmed, open-ended and round-the-clock curfews in at least 19 districts of 7 cities that approximately 1 million 377 thousand people resides (according to the 2014 population census). During these officially declared curfews, fundamental rights of people such as Right to Life and Right to Health are violated and 209 civilians (39 children, 32 women, 30 people over the age 60) were killed by January 26th 2016 and also 1 stillbirth occurred due to gunshot through the womb. In spite of the limited information, existing situation serve adequate evidence which is pointing out desperate conditions.
According to the European Council Human Rights Commissar’s statement, since the last August the curfews which are being declared frequently and widely for an indefinite period of time in neighbourhoods and towns in the South Eastern Region of Turkey are in violation with the principles of proportionality and essentiality which are the requirements of a democratic society.
During this process public hospitals are almost occupied by the special operations police; the hospital gardens are captured by panzers and the emergency services are emptied in order to make them special operations police bases. The emergency service of Cizre State Hospital is emptied and allocated to the police and the intensive care unit has to be turned into emergency service. Especially when the injured security forces and suspects are being brought to the hospitals and during their treatment process the hospital garden and its surrounding are taken under intensive blockade by the security forces and this siege is often reflected to the interior of the hospital. The special operation police commit torture and other forms of ill-treatment against sick and injured people coming to the health institutions.
There are very serious decreases in the number of people applying to the hospitals, and most of the births cannot be done at the hospitals due to unlawful practices. There are very serious obstacles in front of the access of the injured people and patients with chronic diseases to the health institutions. There are dramatic decreases in terms of the criteria such as the daily numbers of applications made to the hospital emergency units, daily numbers of applications made to the polyclinics and in the number of hospital patients in comparison with the previous months. Home care services are greatly interrupted. Attention for health care services which are also taking place in the “Rules about armed conflict and other violent situations” of the World Medical Association is not regarded by the administrative authorities and the security executives.
Such unlawful practice spoils safety in the health environment and at the same time makes health labourers and health institutions its targets. Such an environment creating unsafe conditions spoils the desire to work. Thus many health workers want to get distanced from the places where they live either by taking permission, or by designation or resignation. The health workers expressed that their morals are spoilt by continuing conflicts, treats and oppression and they do not want to work in such conditions. The mental effect of the trauma stemming from the conflict environment show itself as anxiety, depression and acute stress responses. The war environment may result with long term mental trauma in the entire society and especially in the children.
Our member Nurse Eyüp Ergen, working in Cizre State Hospital Emergency Service was shot in his car by the special operations police snipers on the date of 29th August, after he left his hospital. Our member lost his life as the police did not permit the ambulance to enter to the site and he was awaited injured for more than 1 hour. Again our member Şehmus Dursun working in Beytüşşebap, lost his life due to the ambulance in which he was working was put under bullets at the police check-point on the date of 25th September 2015. On the date of 30th December 2015, Nurse Abdülaziz Yural, executive member of the board of SES Cizre representation office, was shot and killed by the special operation police while he was trying to help an injured woman. Many of our members and other non-member health workers were injured and were subjected to threats and insults.
Since the 23 January 2016, more than twenty injured people (including children) are trying to survive at the below zero floor of an apartment in Cizre, which is under constant bombardment. Before and during this incident, democratic organizations and individual initiatives got the interim measure decision from the European Court of Human Rights (ECHR) to guarantee the accession of the five wounded people to the hospitals. Three of them have died (Cihan Karaman, Hüseyin Paksoy and Serhat Altun) due to non-implementation of the decision, one of them is in hospital (Helin Öncü) and she was severely wounded and Orhan Tunç, another wounded man, no one get news about him. In spite of the decisions of the ECHR, the apartment where more than twenty people, including wounded people, are trying to hide themselves from the state security forces is continued to be attacked and the situation of the wounded people get worse by the time.
According to all international Conventions that Turkey is a party to, the fundemantal rights of people such as Right to Life and Right to Health are essential. Therefore, we urge you to conduct country mission to Turkey; investigate areas of concern underlined here and take a prompt action to realise the right to health which includes to urge the Turkish authorities to end the curfew as soon as possible.
